O Procon da Paraíba vai assinar um Termo de Ajustamento de Conduta (TAC) para regulamentar a nova lei estadual que garante aos estudantes o benefício da meia-entrada sem a apresentação da carteira estudantil. A informação foi dada na quarta-feira (21) pela secretária executiva do órgão, Klébia Ludgério. Segundo ela, o TAC será firmado na próxima semana pelo Procon estadual, os Procons municipais e também pelo Ministério Público. A nova lei entrou em vigor na sexta-feira (16) quando foi publicada no Diário Oficial do Estado. De autoria do deputado estadual Gervásio Maia (PMDB), ela garante aos estudantes o direito da meia-entrada em eventos culturais e nas passagens de transporte municipais e intermunicipais apenas com a apresentação de um documento com foto válido em território nacional e um comprovante de que está matriculado em alguma escola, como uma declaração ou carnê de pagamento.
Segundo Klébia Ludgério, o Procon apoia a nova lei e a considera excelente para os estudantes. Ela disse que o objetivo do TAC é para “evitar fraudes e garantir que os direitos dos estudantes sejam respeitados”. A secretaria do Procon disse que entre os pontos que serão estabelecidos no TAC está o controle nas emissões de declarações das escolas, já que o documento servirá como comprovação de que os beneficiários da meia-entrada de fato são estudantes.
Um outro ponto que o TAC pretende controlar é a produção de carteiras de estudantes. O Procon quer estabelecer a cobrança de uma taxa simbólica, que ficará entre R$ 5 e R$ 8, para a carteira. “Inclusive vamos determinar que aqueles que tenham pago por exemplo R$ 15 tenham o direito de ser ressarcido”. Segundo Klébia, a fiscalização do Procon com relação ao cumprimento da lei será intensificada com o TAC. “O estudante que se sentir extorquido pode procurar os Procons e denunciar”, completou.
Reclamações - O deputado Gervásio Maia, autor da lei, disse nesta quarta-feira que tem a lei já está sendo descumprida . De acordo com ele, a Associação das Empresas de Transporte Coletivo da cidade de João Pessoa (AETC-JP), que coordena todo sistema de ônibus capital, e a Viação Rio Tinto não estão dando o benefício aos estudantes. “Eu espero que elas (as empresas) possam ser multadas. Os empresários precisam entender que a lei está em vigor. Estaremos vigilantes para o cumprimento dessa lei”, enfatizou Gervásio.
Ao G1 Paraíba a Viação Rio Tinto negou que esteja descumprindo a lei. O gerente de tráfego da empresa, Walter Galdino, disse que está sendo obedecida a norma que dispensa a carteira de estudante. Por outro lado ele revelou que um outro ponto da norma, o que determina um assentos ilimitados para estudantes em ônibus intermunicipais, não é seguido porque o Sindicato das Empresas de Ônibus determinou que seja cumprida uma lei antiga.
Em contato com a AETC-JP a reportagem foi informada que o diretor executivo Mário Tourinho estava em viagem de férias. A assessoria informou que não conseguiu entrar em contato com ele por telefone e apenas o próprio poderia se posicionar pela associação. O Procon estadual informou que da sexta-feira, quando a lei foi publicada, até esta quarta-feira o órgão já recebeu pelo menos três reclamações por descumprimento apenas em João Pessoa.

In contact with JP-AETC the report was informed that the executive director Tourinho Mario was on vacation. The advisory said that unable to contact him by telephone and myself could only stand by the association. The Procon state said on Friday, when the law was published, until this Wednesday the agency has received at least three complaints for noncompliance only in Joao Pessoa.
